TEEN WAS FATALLY SHOT IN HOME OF PRECINCT ONE CAPTAIN CARL SHAW

Meyerland, Tx  (1-25-16)   A 15-year old boy is dead after he was shot by his step-brother on January 16 in the Meyerland home of Carl Shaw, a captain with the Harris County Precinct One Constable's office.

According to police, the shooting appears to have been accidental and will be referred to a grand jury.

Police said Shaw's son, 20, was showing the 15-year old a semiautomatic pistol that belonged to Shaw when the gun accidentally discharged. According to the Harris County Medical Examiner's office, the boy was shot through the left arm into the chest and was pronounced dead at the scene. HPD investigators told KTRK that Shaw was not home at the time of the shooting.

According to his LinkedIn profile, Shaw has been captain with the constable's office since 2013. Prior to that, he worked at O'Quinn Law Firm, where he was involved in a high-profile ambulance-chasing scheme about 20 years ago. Shaw and two other attorneys working for the law firm were accused of hiring runners to recruit clients after a fatal South Carolina plane crash in 1994. Shaw was charged with conspiracy, solicitation, splitting fees with non-lawyers and practicing law without a South Carolina license. He eventually pleaded guilty to improper practice, a misdemeanor. His other charges were dismissed upon pleading guilty to the misdemeanor.

Lawrence shooting sends one man to hospital; likely ‘accidental discharge,’ DA’s office says

Lawrence, KS  (1-25-16) - Lawrence police say a 25-year-old man shot another man Saturday night, sending him to the hospital.

Around 9:15 p.m., officers arrived at a home in the 1500 block of Pinewood Drive for a report of a shooting, said Lawrence Police spokeswoman Kim Murphree. There, officers found a 21-year-old man lying on the ground in the garage with a towel wrapped around his calf and about four witnesses around him.

"It appears to be a case of accidental discharge," said Cheryl Wright Kunard, Douglas County District Attorney's Office spokeswoman. "We are reviewing the reports to determine if any laws were broken."

The victim — whose name has not been released — suffered a single gunshot wound to the leg, Murphree said. He was taken to Lawrence Memorial Hospital and later transferred to a Kansas City-area hospital for treatment. A condition report was not available Monday.

Witnesses told police the suspect was holding the gun when it fired and hit the victim, Murphree said. She noted the suspect and victim know each other.

(occurred June 20, 2015.  Claim of shooting caused by training/ muscle memory)
Video: Minn. officer accidentally shoots, wounds suspect after pursuit

EDEN PRAIRIE, Minn. (1-25-16)  — The officer later said firearms training 20 days prior might have been a contributing factor to muscle memory.  Police released video of an accidental shooting after a pursuit, FOX 9 reported.

Eden Prairie Sergeant Lonnie Soppeland had been pursuing then 21-year-old Matthew Hovland-Knase at speeds reaching 110 miles per hour on June 20, 2015. Eventually, Hovland-Knase pulled over to the side of the road and Soppeland jumped out of his cruiser with his gun drawn.

Soppeland commanded Hovland-Knase to raise his hands before accidentally firing. Hovland-Knase yelled, “I’m bleeding.”

Soppeland immediately administered aid and apologised to the suspect.

In the dash cam video, the two exchange words and acknowledged the shooting was not intentional.

Soppeland later told a detective during the investigation of the incident, “I drew my firearm with my right hand, I planned to steady it with my left hand. When my hands made contact, the firearm discharged once unintentionally. It was not my conscious choice.”

The detective asked if firearms training 20 days prior when Soppeland fired 50 to 100 rounds was a factor. Soppeland said it was.

“I feel the muscle memory from that recent training of squeezing the trigger contributed to the unintentional discharge during a high stress situation,” Soppeland said in the report.

Several firearms experts told the news site they had never heard of accidental shootings blamed on muscle memory but thought the stress of a pursuit could have been a factor.

“I'm not going to second guess the officer, but generally speaking, until you're ready to fire, your finger is alongside the slide or frame of the gun,” law enforcement firearms trainer John Caile told the news site.

Hovland-Knase was convicted of fleeing an officer last year. Soppeland is an 11-year veteran of the department.

A statement released by the police said based on the findings of the investigation, no further disciplinary action was taken.
