Ala. police arrest 13-year-old in shooting case of 12-year-old

BIRMINGHAM, Ala. (12-3-15) -- A boy is in custody after police say he shot another boy at a Birmingham playground.

News outlets report that on Nov. 25, a 12-year-old boy was shot in the leg at a playground outside Hayes K-8 School in North Birmingham. After initial questioning, police said the shooting might have been accidental.

However, on Tuesday police said the shooting was actually intentional. Birmingham Police Lt. Sean Edwards says a 13-year-old boy has been taken into custody and has been charged with second-degree assault.

Edwards says some "jokes or other words" were exchanged between the boys, which led to the shooting.

He says it's unclear exactly how the 13-year-old got his hands on a gun. The boy told police he got it from a friend.

CADILLAC – (12-3-15)  A 3-year-old Cadillac boy is expected to recover after he was accidentally shot in the arm by his 7-year-old brother Monday morning, according to Cadillac Detective/Lt. Todd Golnick.

The shooting at the family's apartment at 607 Cadillac Shores Drive was reported to police shortly after 9 a.m. Monday.

No charges or citations are expected to be issued, Golnick said, declining to release the names of the boys and their parents.

While the father was at work and the mother was caring for the two boys' three other siblings, the older boy got hold of ammunition that was stored high in a kitchen cupboard, Golnick said. The older boy then went upstairs into his parents' bedroom, where a hunting rifle was hidden, he said. He loaded the weapon and began playing with it. It accidentally discharged, the bullet striking the 3-year-old's arm, Golnick said.

The boy was transported by Northflight EMS to Mercy Hospital, where his condition is unknown.

“His wounds don't appear to be life-threatening, but he has very serious injuries to an arm,” Golnick said.

The children's father is legally permitted to own a gun, Golnick said, adding the parents did everything they could possibly do to keep the weapons away from the children, including storing the gun and ammo separately, hiding the gun and keeping the ammo in a place where the children couldn't immediately access it. But there was no gun safe or gun lock for the rifle, police said.

Cadillac police were wrapping up the investigation on Monday. They were assisted by the Wexford County Sheriff's Office and the Cadillac Fire Department.
