West Delray Beach, Fl      (2-4-16)    A 16-year-old boy was accidentally shot and killed by a friend after they got their hands on a gun while the friend's parents weren't home, according to a lawyer representing the dead boy's family.

Kingsport man arrested in accidental shooting of girlfriend's son

Kingsport, Tn  (2-4-16)  — The discovery of drugs within a home has led to a houseguest being shot in the chest, according to police, as the resident inadvertently fired a round while kicking him out.

The incident occurred at approximately 8 p.m. Wednesday at 1326 Frank St. A Kingsport Police Department incident report states that multiple officers and EMS personnel responded to the scene, with the 33-year-old victim transported to Wellmont Holston Valley Medical Center. As of Thursday morning, he remained hospitalized in stable condition.

Clifford Parker, 54, told investigators that he had been letting the man stay at his residence. Also present at the time of the shooting was the victim’s mother, who is identified as Parker’s girlfriend.

According to KPD Public Information Officer Tom Patton, Parker discovered a small amount of drugs and drug paraphernalia. After tracing the items back to his girlfriend’s son, Parker reportedly demanded the man pack his belongings and leave.

During the ensuing altercation, Parker retrieved a handgun and was allegedly pointing it at the other man in an attempt to expedite his departure. One round was fired, according to police, but investigators believe the shooting was unintentional.

Immediately following the incident, both Parker and his girlfriend were transported to the police department for further questioning. Parker was ultimately charged with reckless aggravated assault and booked into the city jail, then later released on $5,000 bond.

An investigation into the drugs discovered in Parker’s home is continuing with charges pending. Patton says a “significant” amount of cash was also seized from the residence. Police suspect the money is proceeds from drug transactions.

Jeremiah Adam Baker, 40, of the 100 block of Lasso Lane, was charged with possession of a firearm by a felon, a Sheriff's Office release said.

The incident, reported at 11:51 a.m., happened at a mobile home on the 500 block of Rockfish Road, according to the release.

Man accused of accidentally firing gun while drunk, wounding child (through wall)

South St. Louis, Mo, (2-4-16) A man, 29, is facing charged for allegedly accidentally shooting a 7-year-old boy while drunk.

Jeffery Eckstein is charged with second-degree assault and unlawful use of a weapon.

The boy was injured after a gun accidentally discharged in a south St. Louis apartment Tuesday night, according to police.

The 7-year-old was asleep on the couch in a second floor apartment on South Grand.

Police say Eckstein suspect in the case lived downstairs. He had a gun. It went off and the bullet went through the floor of the upstairs apartment.

The boy and his 9-year-old brother were sleeping on this couch when the shot rang out. The bullet came through the floor and the couch cushion and struck the boy in the hip.

“I said that was a gunshot,” Brenda Shepard-Bennett said. “Couldn't believe it, but I knew what it was.”

Shepard-Bennett lives in the apartment and says the boy who was shot is the younger brother of her daughter's boyfriend. She says the bullet shattered his hip.

“He woke up howling, ‘Ah… Ah,’ and I said he been shot,” Shpeard-Bennett said. “Y'all think he fell, he didn't' fall that was a gunshot.”

Shepard-Bennett says the suspect in the case had only moved in downstairs last week. The building owner says he had told her that he was a vet who needed a place to stay.

But there were some red flags and Nancy Kreis says a family member was already starting to check into the suspect's background.

“I do know he misrepresented some things about his service in the army,” Kreis said. “He said he was a vet, a ranger and deployed four times, don't know if any of that's true, don't think it is.”

“If he is under the influence, what is the difference between him operating a vehicle and operating a gun,” Kreis said. “You shouldn't even have a gun in your presence if you know you under the influence and you might make a mistake, there's people up there, could be me or my husband and it happened to be a little boy.”

She says that the boy who was shot will have to have extensive surgery and could be in a wheelchair for up to two months.

The boy was conscious and breathing when he was taken to a hospital. He was listed in stable condition Wednesday morning.

Eckstein is being held on a $50,000 cash-only bond.

UPDATE: Boy allegedly shoots teen, mother and brother alter the crime scene

Melville, La   (2-3-16)  A 12-year-old boy allegedly shot and killed 15-year-old Tra'von Edwards on Saturday and then contacted his mother who allegedly altered the crime scene before calling police, according to an arrest affidavit obtained by our investigative team.

Twanda Louray Washington, 33, was arrested for obstruction of justice and contributing to the delinquency of a juvenile Tuesday. Her 12-year-old son was arrested for negligent homicide, along with his 15-year-old brother, who was arrested for obstruction of justice.

The 12-year-old boy told St. Landry Parish deputies on Tuesday that he accidentally shot Edwards. He said he contacted Washington, who arrived to confirm that Edwards was dead. She and two of her sons allegedly altered the scene where the body was located, according to the arrest affidavit.

Washington was the person who reported Edwards' body to the St. Landry Parish Sheriff Office on Saturday. She told officers that she found the body after an extensive search for Edwards, after she learned that he never came home from school. Deputies questioned her story after anonymous sources and the victim's family said she had something to do with the death.

Deputies originally could not determine Edwards' cause of death because there were not any obvious signs of injury, according to the affidavit. After an autopsy, they learned that Edwards was shot once in the upper hip area with a .22 caliber rifle.

Washington remains in the St. Landry Parish Jail on a $30,000 bond.

Deputies: Man in serious condition after being shot in the face

Houston, Tx  (2-2-16)  – A man is in serious condition after he shot himself in the face in what is believed to be an accidental shooting.

According to the Harris County Precinct 1 Constable’s Office, deputies responded to a call of a shooting at 9:20 p.m. Monday at the Woodglen Village Apartments, located in the 11100 block of West Montgomery Road in northwest Houston.

When deputy constables arrived at the scene, they found a man shot once on the mouth/face area.

Deputies said it all started when four men in a car pulled into the apartment complex. They parked the vehicle and three of the four got out to walk to an apartment.

As they were walking away, they heard a gunshot, turned and ran back to the car. They then found the victim by himself shot.

Investigators believe he was looking at the gun, whomever it belonged to, and it went off as he was handing it. They did not say it looked like he did it on purpose.

Investigators stated it was still under investigation, and they were verifying what happened.

After the three men found him in the car, they jumped in to take him to the hospital. As they turned onto W. Mount Houston, they saw a deputy coming down the road, so they went the wrong direction at the deputy to get his attention.

The shooting victim was transported to Ben Taub Hospital in serious condition.

DA: Man shot himself with illegal firearm in Endicott

Endicott police were called just after midnight to the area of Nanticoke Avenue and East Franklin Street just after midnight, where the officers found the man with a gunshot wound.

Police investigated and and witness statements helped them determine this was an accidental and self-inflicted gun wound and not a suicide attempt, the DA's office said Tuesday.

There is no active search for a shooter in this case, Cornwell said, but criminal charges are pending against the 23-year-old. His identity was not released Tuesday by law enforcement officials and the type of firearm used was also not identified.

Area man dies from gunshot wound

Pittsburg County, Pa  (2-2-16) An area man has died of what authorities say appears to be a self-inflicted gunshot wound that reportedly occurred while he was drawing and putting a handgun into a holster.
Michael David Miller II, 35, of Lakeview Drive in rural Pittsburg County, died early Saturday at the McAlester Regional Medical Center, according to sheriff’s reports.
A witness told sheriff’s deputies that Miller was standing in front of a mirror at his residence, drawing a weapon from a holster and then putting it back in the holster when the witness heard a gunshot. The witness reported that Miller turned and said he had shot himself in the leg, according to reports.
The witness and another friend at the residence, who was awakened by the gunshot, reported that Miller said he had accidentally shot himself. After calling 911, they helped Miller to a truck.
Pittsburg County deputies who were traveling down Lakeview Drive on the way to the scene met the vehicle in front of Talawanda Ranch, according to sheriff’s reports. Two people in the back of the truck were holding Miller, who was wrapped in a blanket, the report states. Miller had a wound in the front part of his leg, near the waist line, according to a statement from Deputy Michael Coffman. Deputies Cody Vaughn and Cory Cantrell attempted to find a pulse and began chest compressions on Miller, according to Coffman.
When an ambulance arrived, paramedics began medical treatment. Miller was subsequently transported to McAlester Regional Health Center, where he was later pronounced deceased, according to sherif’s reports.
Pittsburg County Sheriff Joel Kerns said the matter remains under investigation and that his office is awaiting a report from the State Medical Examiner’s office before issuing a final report.

Naked gunman arrested in Murfreesboro

MURFREESBO, Tenn.  (2-2-16) - Nashville CBS affiliate WTVF reports that a naked man armed with a gun was arrested after firing off several rounds.

Reporter Nick Beres said Murfreesboro police arrested 21-year-old Cadari Lindsey after witnesses reported he was seen screaming and waving the gun around before firing at least 8 rounds into the air.

"It was one of those things where you think: What did I just see? It was one of those what happened kind of moments," Tammy Brown told WTVF.

"When officers confronted the individual he immediately began firing shots, not directly at the officers. He did wave the gun at the officers," said Sgt. Kyle Evans. He told WTVF that officers kept their distance until they noticed the gun had cycled to a locked-back position.

"Basically that's a tell tale sign that the gun has ran out of ammunition," said Evans.

WTVF reported that's when officers used a taser to take Lindsey down. That's when they noticed he accidentally shot himself in the leg.

Reporter Nick Beres said Lindsey was expected to be charged with 8 counts of aggravated assault.

Fairbanks police investigate soldier’s death in accidental shooting

Fairbanks, Ak  (2-1-16)   A Fort Wainwright soldier died Sunday in what U.S. Army officials call an apparent accidental shooting involving a non-service weapon.

U.S. Army Alaska spokesman John Pennell said cavalryman Sgt. Nathan Michael Higginbotham, 25, died early Sunday after he was shot in Fairbanks. According to a statement from the Fairbanks Police Department, a 9 mm pistol was recovered from Higginbotham at the scene. He had a single gunshot wound to the head, police said.

“(Higginbotham) died after a privately owned firearm he was handling accidentally discharged,” Pennell wrote. “No others were harmed in the accident. No foul play is suspected.”

Police said at least two other people witnessed Higginbotham’s death, but law enforcement isn't releasing their names or “what actions Sgt. Higginbotham was taking with the firearm at the time of its discharge.”

Higginbotham -- originally from Schenectady, New York -- was a member of the 5th Squadron in the 1st Cavalry Regiment, 1st Stryker Brigade Combat Team, 25th Infantry Division. Formerly assigned to Fort Hood, Texas, he served in Iraq in 2011 before being assigned to Fort Wainwright in 2013.

Will County judge back on bench after accidentally shooting himself in hand

Joliet, Il  (2-1-16)  Will County Associate Judge Robert Brumund was on the bench Monday, just two days after he accidentally shot himself in the hand.

Brumund, who presides over family court, confirmed the accident and said he was "embarrassed" by it.

"It's an unfortunate accident that occurred when I was handling my gun," he said. "(It was) a stupid incident."

He said no one else was injured and that his hand was fine.

"Nothing was done intentionally," said Brumund, who has been a judge since 2005.

Although Joliet police would not name Brumund, they said they responded to an incident when asked about a possible accidental shooting involving a judge.

According to police, officers responded to a call of an accidental shooting about 3:25 p.m. Saturday. When officers arrived, they found the victim with a gunshot wound in the hand, Joliet police Deputy Chief Edgar Gregory said.

The weapon was a semi-automatic handgun, Gregory said.

Gregory said the victim told police he had just returned from a shooting range and was about to clean his weapon when it discharged. Gregory could not say whether the victim knew there were still bullets in the gun or not.

The bullet entered the palm and exited through the back of the hand. Gregory said the victim was taken to Presence St. Joseph Hospital where he was treated for his injury. Gregory said the victim's wife was home at the time, but she was not injured.

Police took the gun from the home, said Gregory, adding that the case is still being reviewed.

The victim had a valid Firearm Owners' Identification card, Gregory said.

Questions linger after homeowner shoots, kills accidental intruder    (Defense)

Spokane, Wa  (2-1-16)  Many questions remain unanswered since a fatal shooting in the 6500 block of North Assembly over the weekend after a man shot who believed to be an intruder in his home.

That person he thought was an intruder turned out to be a neighbor.

When Spokane police arrived, they found a man outside of the home with a gunshot wound. He later succumbed to his wounds.

The family of the man who died identified him as "Jerry" but wanted the medical examiner to say the rest. Police have released the name of the shooter and they aren't sure if they will because they don't know if he has committed a crime.

What is known is that a woman called 9-1-1 after her husband thought he shot what he thought was an intruder. The only big clues left at the scene were a blood stain on the porch and grass, and broken glass on the front door.

The slain man's family said he wasn't trying to intrude in the home; that their home is just three doors down and looks very similar to the one where he was shot. They added that he just moved to the area and believe that he mistook the house as his own after a night of drinking.

One of the many questions that has gone unanswered so far is what that person was doing before he was shot and whether or not the shooting was justified.

“There has to be an immediate, and otherwise unavoidable threat of death or great bodily harm to the innocent,” firearms expert Robert Smith said.

Smith teaches about the legality of using firearms as a defense and served as an expert witness during the Gail Gerlach trial. In that case, Gerlach shot a man who was stealing his truck. Smith explains that it comes down to if the shooter's actions were justifiable and reasonable under the circumstances.

“It's not just enough to say, 'I was in fear of my life.' That's a common misnomer, it gets bandaid-ed a lot and it won't take you very far in a court of law,” Smith said. “Everything is always, not what it appears. So until we have all the facts, which the police are investigating, it's difficult to make any judgments.”

Major Crimes detectives are continuing to investigate the shooting, while the medical examiner will be performing an autopsy in order to confirm the identity of the person who was killed as well as their cause of death.

Antioch: Police arrest 86-year-old man suspected in shooting

Antioch, Ca (2-1-16) -- An 86-year-old man who called police on himself was arrested last week for allegedly firing his revolver during a dispute with his roommate, police said.

Pervis Cohen, of Antioch, was arrested after he called police around 8:30 a.m. on Jan. 25, to report that he'd discharged his weapon while arguing with his roommate in the front yard of his home, on the 3000 block of Larkspur Drive.

The reason for the shooting? Cohen said his roommate was hurling rocks at him, so he fired a warning shot in the air, then accidentally discharged his weapon a second time as he was bringing it down. The second shot missed the roommate but hit a neighbor's garage door, police said.

Police were skeptical of Cohen's version of events.

"(An accidental discharge) like that is usually not possible with a revolver, because a revolver is double-action," Antioch police acting-Lt. Tom Fuhrmann said.

The unidentified 30-year-old roommate was not arrested, and no injuries were reported. Cohen was arrested on suspicion of assault with a firearm and willful discharge of a firearm with negligence, but the DA has not filed charges against him, police said.

On Saturday, a Cape Coral man suffered multiple wounds in a shooting on McGregor Boulevard in south Fort Myers.

A report by the sheriff's office said that shortly before 4:45 p.m. deputies were called to McGregor near Gladiolus Drive where they found the man inside a car with gunshot wounds to his left forearm and lower left chest area.

Relatives of the man said that another man had shot the victim while he was in a black Buick SUV. A brother of the victim and another friend said they left the area for their own safety and then called for medical help.

A friend of the victim's said the shooter was wearing a red hoodie and dark cargo shorts and had dreadlocks.

Another witness said the man approached their car and shot into it three times, striking the victim twice.

He was taken to Lee Memorial Hospital. A hospital spokeswoman said on Monday that no person by that name was registered at the hospital.

On Friday, two reports of shootings included a mother who was driving with her two daughters when her car's window was shattered by a gunshot and shots fired at a Palm Beach Boulevard business.

The sheriff's office reported that the woman told them she was leaving her home near 13th Street in Lehigh Acres shortly before 8 p.m. when the rear window on her 2007 Honda Odyssey blew out.

The woman said she had been driving with her twin five-year-old daughters.

Deputies found what appeared to be a bullet mark in the window and headliner of the van. A .22-caliber shell casing was found on the street nearby.

The woman and her daughters were not hurt.

The second Friday incident occurred at a business on Palm Beach Boulevard around 8:30 p.m.

A worker at a tire and auto body shop on Palm Beach said he heard what sounded like firecrackers and then saw a leather jacket hanging on a workbench inside the shop move.

Employees at the shop said they saw four people wearing hoodies in a nearby vacant lot but no weapons.

When employees shook the jacket a partial bullet fell out and they found a hole in the sleeve.

Other witnesses nearby said they heard the shots but did not see anybody shooting.

Charlotte pastor found dead of accidental gunshot wound in Union County home

Charlotte, NC   (8-29-15)   Bishop Phillip Davis, founder and senior pastor of Nations Ford Community Church in Charlotte, was found dead Saturday inside his Union County home, apparently the victim of an accidental gunshot wound, the Union County sheriff’s office said.

Davis, 62, was apparently cleaning his pistol at his home in Weddington when it accidentally fired, striking him in the chest, the sheriff’s office said in a statement. He had invited his adult son to go to a firing range with him later that day.

Cynthia Davis, his wife of more than 40 years, called 911 shortly after 1 p.m. Saturday and said she found him collapsed at his desk. She attempted to administer CPR.

“The investigation revealed no signs of foul play, and the evidence confirms this was in fact an accidental death,” the sheriff’s office said in the statement.

Buckeye police investigate accidental shooting of teen girl

BUCKEYE, AZ (8-28-15)  Buckeye police are investigating the death of 17-year-old Dannielle Rangel after her family says a rifle fell over and accidentally discharged a bullet, striking Rangel in the head.
On Monday around 10:30 p.m., Rangel's family says her brother was moving his rifle, a 22 caliber AR-15. He allegedly set the rifle down and it fell over and went off.

Rangel was rushed to a nearby hospital, but died the next day. Her uncle, Arthur Velasquez, says the family is devastated to lose a girl who was so full of life.

"She was very outspoken; she was always cheerful. She was always polite," Velasquez said.

The family also says she had a bright future ahead, looking forward to college and a career in law.

"She was getting prepared to take college courses to go into college and she wanted to be a district attorney," Velasquez said.

The family is facing a new crisis: how to pay for her funeral. They have set up a gofundme site to help.

Police are investigating, but no charges have been brought against her brother

The victim, Hunter Harbin, was accidentally shot in the gut by his stepbrother, 17-year-old Austin Dewayne Stapp.

Officials: Man accidentally shoots another while showing handgun he was trying to sell

NEWBURG, WI   (1-31-16)  — Officials with the Washington County Sheriff’s Office say a 36-year-old Village of Newburg man accidentally shot a 35-year-old Town of Farmington man, while showing him a handgun that he was trying to sell.

The incident happened inside an apartment building on Main St. in Newburg shortly after 1 a.m. on Sunday, January 31st.

Deputies and a detective investigated the scene. The investigation revealed the handgun had not been completely cleared of ammunition, and it had discharged a bullet into the arm of the victim. The round had not penetrated into any other apartments.

The discharge appears to be accidental in nature. However, the Village of Newburg man was believed to be intoxicated at the time, and was taken into custody for intoxicated use of a firearm.

The victim was transported to Froedtert Hospital for non-life threatening injuries, and was treated and released.

Iowan shot with own rifle at shooting range, authorities say

PANORA, Iowa (2-1-16) - Authorities say a man was wounded by a shot from his own rifle in a Guthrie County shooting range accident.

The accident occurred a little before 1 p.m. Sunday at Bays Branch shooting range near Panora. Authorities say the man propped his .17-caliber rifle on some sandbags on the shooting bench when he went down range to fix his target. As he was re-placing his target, the rifle fell off the sandbags and fired. The bullet went through the man’s left arm and struck his upper torso.

He was taken to a Des Moines hospital. The Iowa Natural Resources Department identified him as 33-year-old Jeremy Cooper, of Bagley.

Man injured in accidental South Hero shooting

South Hero, Vt  (2-1-16)  A man was injured inside of McKee's Island Pub & Pizza in South Hero on Sunday in an accidental self-inflicted shooting, Vermont State Police said.

The incident occurred around 7:30 p.m.

Vermont State Police Lt. Lance Burnham said police on Monday are receiving conflicting reports about what caused a man's .45 caliber pistol to go off. Burnham confirmed that police are receiving some reports that the man, Zeberiah Snow, 31, of South Hero, slipped and fell in the bathroom, causing his gun to discharge. However, the Snow's report contradicts these stories, Burnham said.

The incident is not being considered suspicious, Burnham said. The man was transported to the University of Vermont Medical Center in Burlington on Sunday night for treatment of a gunshot wound to the hip, and he remains there on Monday morning. His injuries were not life-threatening, Burnham said.

Responders from South Hero Rescue, Vermont State Police and the Grand Isle Sheriff's Department responded to the scene.

After a South Hero volunteer fireman secured the injured man's weapon, members of South Hero Rescue entered the establishment and provided him medical attention, before transporting him to the hospital. The firearm was turned over to the Grand Isle Sheriff's Department.

Investigation into the incident is ongoing.
